    It's Getting Sticky

    .. Dozens of images from this blog have been used across the web and in print media of various sorts. Each image is non-commercial and carries a Creative Commons License, (see bottom of sidebar.) Some have even been purloined by unscrupulous shagnasties in their pursuit of filthy lucre to line their pockets. It's in the nature of marketing and marketeers to do what ever they can to make a buck.
    .. Recently public lands managers have jumped on the permit process to enhance their revenue streams and regulate the use of images taken on public lands. A few years ago Yellowstone National Park implemented a permitting process for "Film, Photography, and Sound Recording."  We've mentioned it in passing a couple of times.
    .. Now, the United States Forest Service has initiated a rule-making process about commercial photography in wilderness areas of National Forests. It may seem like an insignificant bit of bureaucratic nonsense but; it could affect just about anyone that takes a snapshot on public lands of the National Park Service or the United States Forest Service.
    .. We've been informed that the Bureau of Land Management and Bureau of Reclamation are also considering rule-making and permitting procedures.
    COMMERCIAL USAGE ?
    .. Hatch Magazine recently ran a piece about the impending USFS rule-making procedure.
    .. Action was taken by the Outdoor Writers Association of America and Hatch Magazine to clarify the proposed rule and it's implications for photography and photographers.
    .. If you've read this far you probably think that this is just stuff and nonsense. It certainly can't affect your standard hero shot that you take of a gasping fish that is oxygen starved out of the water in the park or in the forest. That's true unless it's used in a commercial publication.
    .. That commercial publication can be a motion picture, a published print book, on-line-magazine, or blog that is monetized with advertising from commercial ventures such as tackle makers, apparel purveyors, or feather merchants, etc. Advertising posters, product catalogs, mailers, and leaflets are not exempt from the commercial standard.
    .. This is where the law gets as sticky as flypaper. It's going to take some court cases to sort it all out. Resolution may eventually center on the original intent and circumstances of the original image and it's original purpose. Lawyers are about to have a field day.
    .. Recent events in Missouri have shown how ignorant of the law some police officers appear to be. Photographers have rights that are constitutionally protected in the taking of pictures. It's the use of those pictures that bothers officials of all stripes. It is incumbent upon anyone that snaps a picture to understand the law regarding their actions and the use of the resulting image.
    .. A couple of interesting definitions come into play in this legal morass: Is the use of the image in the service of "NEWS" and the precept that "THE EYE CAN COMMIT NO TRESPASS."
    .. For example is it "news" when a monetized blog illustrates and extolls the virtues of an advertisers' new product? Is it news when an outdoor writer in the "newspaper" praises a travel trip to an exotic destination and uses images from the trip of a lifetime ??
    .. So then: where was it taken, for what purpose was it taken, how is it used?

    .. Yesterday the Supreme Court of the United states handed down a decision in the case of PPL Montana vs. State of Montana.
    .. As of this moment Montana probably owns less river bottom than it thought. As of this moment there is great celebration in the PPL offices in Billings, Montana. As of this moment fly fishers and other recreational users of Montana's waters have some worries. As of this moment the courts in Montana have the herculean task of trying to be a bit more considered in their application of laws and precedents. As of this moment it seems that the law of the land has been changed regarding the definition of navigability. As of this moment there may be fewer rivers where access is legal because of the navigability precedent.

    .. So, Batman, what's it all mean? Well, as in many Supreme Court cases, the high court has criticized the lower courts for playing fast and loose with the law and remanded the case for correction.
    .. Interestingly the test of ownership by navigability seems to have been glossed over by much of the post decision analysis. The test of navigability at the time of statehood could be a genuine ball buster if title and ownership questions arise about current water that was not in existence then. At present there is not a set precedent - YET.
    .. Finally it also means that fly fishers have just one more thing to worry about on the river and stream access front. Consensus seems to be that the Montana stream access law is not in immanent danger - we'll see: especially if the state does not have title to currently navigable waters that did not exist at time of statehood, (think Mitchell Slough, think the re-arranged Ruby River, etc.)
    .. We believe that the real import of this case will be felt for a long time. It takes no real genius to understand that "navigability," will be a concern in legal cases for several more decades and may really mean: PORTAGE THEN - PORTAGE NOW.  Now there's a can of wigglers for ya!

    .. Got another 4" of wet snow last night.
    .. Snow pack is now 120% of historical snow water content.
    .. Gloomy weather leads to indoor entertainment.
    .. The whole damn house is getting documented with pinhole photography. We'll not bore you with details. This shot makes pretty good wallpaper.

    .. Midges and giant streamers sighted in the environs of Craig, Montana. Get thee to the "Mighty MO."
    .. Lower Gallatin River Canyon heating up like wildfire. No stonies reported but the fish are taking giant subsurface offerings.
    .. The Madison River in the lowlands, where open, is seeing the first of the mayflies and squadrons of snow flies are permeating fisher folk's orifices. Might be a good time to visit.

    .. Despite the outcry from fisher folk this obnoxious bill is trundling along like an out of control steamroller. Opponents of the bill have noted that the response from the interested public is "satisfactory."
    .. "SATISFACTORY" is not what is needed! Words like 'enormous' and 'overwhelming' would be more to our liking.
    .. Send a letter now. Make a telephone call now. Send an email now. This insidious push to remove  access to the public-owned waters of Montana will continue if the response is only "satisfactory."

    The Good Fight

    ALL POLITICS IS LOCAL

    .. Over the last three weeks we've spent the better part of two months rent on gasoline and motel bills, (and not fished for more than about 6 hours.) We've visited with some friends, neighbors, relatives and politicos.
    .. We've traipsed from door to door and from staffer to staffer. We've visited with elected and appointed officials. We are disheartened and enlightened.
    .. Under normal circumstances Helena, Montana would not be our choice of midwinter destinations; however this is decidedly not normal. The Montana State Legislature is in session, (once every two years,) and our seat of government is burbling with conversation ranging from medical marijuana to fishing in ditches.
    .. Unless you've been asleep at the switch, you know about the ludicrous attempt by the Montana House of Representatives to redefine public water into private water. HB 309 is a top player in any search engine right now. Even blogs and images make the hit list. And they should.
    .. We talked to our Representatives and Senators, (a perquisite of old age,) and visited with many staff persons.
    .. We also visited with some DFWP servants and can now provide you with some enlightening news. The old adage "All politics is local," is the watchword in Helena.
    .. While every person we talked with is acutely aware of the mini maelstrom surrounding this bill, they are also aware of the seeming nonchalance from citizens of the State of Montana and the deep concern of citizens from other states.
    .. It may seem callous to note that there is, apparently, more concern from outside our borders than inside. We are awakened and a bit startled!
    .. Our elected representatives need to hear from the citizens of Montana. Newspapers, Television, Blogs, and other "media" can only spotlight the issue. Citizens, however, must make their voice heard.
    .. If you've never done it before, do it now! Write a letter, make a phone call, (or if you must send an email.) Our legislators need to hear from you. The more personal the form of communication, the more effective it is.
    .. An email works. A letter from a constituent carries more weight. A personal visit is truly a heavy vote. And remember, there are people with a lot more money than us that have daily access to the law makers.
    .. Although not a certainty, it looks like our Senate will drown this obnoxious piece of legislation. Write to your Senators and give them the reasons for doing so. Let them know that the citizens of Montana are as concerned as the citizens from other states.

    .. Be direct, polite, and informed. Senators listen to cogent arguments: they can use them themselves.

    The Backdoor

    .. Given the recently added access to $3 Dollar Bridge, it's not surprising that few fishers take the backdoor. But there's some good fishing to be had this time of year by walking the bank and picking your spot.
    .. Spot and stalk, (as hunters would say,) is a possibility, - BUT - there's few very dense hatches in terminal February. Fishing the seams and slick dark water is probably more productive right now.
    .. The Oliff Family has granted a 50' shoreline easement along the Madison River for access to this wonderful wading section of the river. This easement extends from the public access at the Raynolds Pass Can all the way to the $3 Dollar Bridge access.
    .. It's a backdoor worth taking! For us, bank fishing is becoming the norm, and there are many little slicks, debris hides, and 'sweet seams' that are not much more than a rod's-length distance from the shore. The willows provide some cover, especially with the sun low in the southern sky.
    .. We visited this locality twice over the weekend. Caught some good fish and didn't even get in the water.
    .. The sun was bright, the air was still, the snow is well packed and not deep. Both days were - dare we say it - Spring-like.
    .. We've become attached to small streamers, stone flies, soft hackles, and the Yellowstone Winter Grub this year.
    .. An occasional small caddis nymph has been used but our winter assortment this season has been small and productive.
    .. It's not that we lack competent waders, or that the cold water is a problem, nor is it a lack of manly stuff; rather it's the legs.
    ..They begin to wobble after a couple of hours and we'd rather fall in a pile of soft snow than a puddle of cold wet water.
    .. This locality is where the river begins to broaden out. The braided discharge channels from Quake Lake coalesce into the hundred mile riffle right here. Wading can provide access to some wonderful places. And the shoreline is probably not the preferred place. But there are fish to be had and the scenery is wonderful.

    .. Governor Brian Schweitzer signed HB 190 into law. He did it just after we chided him about it. Bless His Bippy. The best statewide news coverage was from KLUR-8 in Billings. It's a short and simple law. Every fly fisher in Montana should read it and abide by it.

    .. Thanks, again, go to our hard working legislators; they took the conversational approach this session - unlike the confrontational approach of last session.

    .. We anticipate a bumper crop of stiles to appear in the next few years. Stiles of all styles are an age-old commonwealth tradition. They are part of English common law.
    .. We would love to see sportswomen and sportsmen rally 'round the concept in Montana. To coin a phrase: "Good stiles make good neighbors."
    .. The folks in the UK have a long standing tradition of community involvement in stream grooming and maintenance. A bit of that would go a long way here. Check out the Penryth Anglers Online site for a stile building and stream maintenance work party.
    .. As you read this the good folks in Livingston are cleaning up the Yellowstone River. Good going guys. April 22 is EARTH DAY.

    .. It's looking like the Montana State Legislature will finally affirm the Montana State Constitution by approving a bill to clarify stream access from bridge and road crossings.
    .. It also looks like the hard work by several legislators has brought some conversational sanity to the issue - and like all compromise legislation, everyone is a bit gratified and a bit disappointed.

Senator Jim Shockley, (R-Victor,) along with Representative Kendall Van Dyk, (D-Billings,) Senator Jeff Essmann, (R-Billings,) and organizational representatives from Montana Trout Unlimited, Montana Stockgrowers Association, Montana Department of Fish, Wildlife & Parks, worked long and hard on the current compromise.
    .. The two major changes in the bill that brought the parties together are:
    1] . . .a landowner who owns land next to a bridge crossing cannot be found liable for someone using the road right-of-way for access to a river or stream for recreational use “except for an act or omission that constitutes willful or wanton misconduct.”
    2] . . . the bill doesn’t create any rights nor “extinguishes” any existing rights concerning “prescriptive road rights of way that existed at the time of passage.” These are easements counties acquire after years of traditional use without ever paying for them.
